Applies To: All customers (“Customer,” “you,” “your”) who request, schedule, purchase, or receive services from Epoxify, and all use of our website, forms, messages, and estimates.
By requesting a quote, submitting a form, scheduling an inspection, approving an estimate, paying a deposit, allowing work to begin, or otherwise engaging Epoxify, you agree to these Terms of Service (“Terms”). If you do not agree, do not use our services or authorize work.
If a separate signed contract, scope sheet, proposal, or work order (“Work Order”) is provided, it will be considered part of this agreement. If there is a conflict, the Work Order controls for scope and pricing, and these Terms control for legal terms, warranty rules, payment enforcement, and risk allocation unless the Work Order explicitly overrides a specific term.
“Services” means any surface preparation, concrete grinding, patching, crack repair, moisture mitigation, primer/base coats, metallic epoxy systems, flake systems, polyaspartic or urethane topcoats, sealers, staining, polishing, resurfacing, demolition of coatings, or any related labor/materials provided by Epoxify.
“Project Site” means the location where Services are provided.
“Substrate” means the concrete slab or underlying surface.“Change Order” means any change to scope, system, colors, coatings, preparation level, repairs, timelines, or materials after the estimate or Work Order.
“System” means the full flooring build, including prep, primers, body coats, broadcast layers, metallic or pigment layers, and topcoats.
“Substantial Completion” means the point at which the floor is installed and usable for intended purpose, even if minor touch-ups remain.
Information on our website, social media, and in messages is general and may not match your Project Site conditions. Submitting a form does not create a binding contract. All pricing is subject to confirmation after an inspection or adequate documentation (photos, measurements, moisture conditions, and existing coating status).
Unless explicitly stated otherwise:
Estimates assume typical access, typical concrete condition, and typical prep requirements for a long lasting bond.
Estimates may assume the site is clear of items and vehicles.Estimates may exclude removal of unknown coatings, mastics, paint, oil contamination, glue, or moisture problems unless included in writing.
Quotes are typically valid for 7 to 14 days unless stated otherwise, because material costs and scheduling availability can change.
You are purchasing a professional installation service and a coating system applied to a substrate that has its own limitations. Concrete varies significantly. Results depend on:
-slab condition
-hardness and porosity
-contamination
-cracks and movement
-moisture vapor emission and hydrostatic pressure
-temperature and humidity during installation and cure
-prep level achieved and required
A typical Epoxify install may include:
1. site protection and masking
2. mechanical grinding to target profile
3. crack chase and fill as needed
4. patching/spalling repairs as needed
5. vacuuming and dust control
6. primer/base coat selection based on substrate needs
7. metallic body coat and pigment effects or broadcast layer
8. topcoat selection (urethane/polyaspartic/etc.)cure and return-to-service guidance
Exact steps depend on the Work Order and Project Site conditions.
You agree to:
1. Provide safe access to the Project Site, including power and water if needed.
2. Ensure the Project Site is cleared of vehicles, storage, shelving items, appliances, and personal property unless Epoxify agrees in writing to move specific items.
3. Provide accurate measurements and disclose known slab issues, prior coatings, adhesives, water intrusion history, plumbing leaks, roof leaks, or moisture history.
4. Keep children, pets, and unauthorized persons away from work areas.
5. Follow cure-time instructions for foot traffic and vehicle traffic.
6. Maintain proper drainage around the slab where applicable, and address water intrusion sources where applicable.
If you do not clear the site, Epoxify may:
reschedule and charge a trip fee,
charge labor for moving items, and/or
refuse to begin work until the area is workable.
Installation dates are scheduled as a window. Start dates and completion dates are estimates, not guarantees, because coatings are sensitive to temperature, humidity, substrate condition, and cure behavior.
We are not responsible for delays due to:
weather, humidity, or temperature conditions unsuitable for coating
unexpected substrate conditions discovered after grinding
material supply delays
power outages or site access issues
customer-caused delays (site not cleared, access denied, indecision on colors)other trades interfering (plumbers, electricians, painters)structural or slab movement events
If you reschedule within 72 hours of scheduled start (or other stated window), Epoxify may charge a rescheduling fee, plus any non-refundable material cost already ordered.
You agree that a deposit is required to secure scheduling and initiate procurement. You stated the deposit will generally equal material cost, and we will treat it that way by default.
Deposit Amount: Typically equal to estimated material cost for your system and square footage, unless otherwise stated in writing.
Deposit Timing: Due upon acceptance of the estimate, before ordering materials and reserving dates.
Deposit Purpose: Materials procurement, mobilization planning, scheduling hold.
Because materials are ordered specifically for your job, deposits are generally non-refundable once materials are ordered, tinted, allocated, or scheduled labor is committed. If you cancel before materials are ordered, Epoxify may refund all or part of the deposit minus administrative time, design time, travel, inspection, or card processing fees if applicable.
Unless the Work Order states otherwise:
Final payment is due immediately upon completion (same day) or by end of day when the floor reaches Substantial Completion and is turned over.
If the project is multi-day or large commercial, Epoxify may require progress payments tied to milestones (e.g., after prep, after base coat, after topcoat). We decide this based on job size and risk.
You may pay using:
-Zelle
-Bank transfer (ACH/wire)
-Cash
-Check (subject to funds clearing)
-Other low chargeback risk methods approved by Epoxify
If you want to accept cards later, Epoxify may do so only with strict rules (ID verification, signed authorization, and card processing fee), because chargebacks are common in contracting.
Returned checks or failed transfers incur:
-a returned payment fee (e.g., $45 or maximum allowed by law)
-plus any bank fees incurred by Epoxify
-and the balance becomes immediately due by cash, Zelle, or wire.
If any invoice is not paid when due:
-Interest accrues at 1.5% per month (18% APR) or the maximum allowed by California law, whichever is lower.
-A late payment fee may be assessed (reasonable and legally permitted).
-Customer is responsible for all reasonable collection costs.
If payment terms are not met, Epoxify may:
stop work immediately,
withhold final documentation, warranty confirmation, and future service,
and reschedule completion only after payment clears.
For non-payment, you agree Epoxify may pursue all legal remedies, including but not limited to:
-filing a mechanic’s lien to the fullest extent permitted by California law,
-sending notices required for lien rights,
-pursuing collections, small claims, or civil action,
-recovering attorney fees and costs if allowed by the Work Order or law.
You acknowledge that failure to pay is not a “dispute,” and you may not withhold payment for non-material, cosmetic, or subjective reasons when the scope was completed.
A Change Order may occur due to:
-additional cracks, spalling, or repair needs discovered after grinding
-moisture conditions requiring mitigation
-existing coating removal not disclosed or not visible until prep begins
-customer changes to color, design, metallic effects, flake size, topcoat type
-added rooms or square footage
-accelerated timelines or after-hours work requests
Change Orders must be approved in writing (text/email acceptable). Epoxify will provide pricing or time-and-material terms.
If immediate action is necessary to protect project integrity (example: discovering contamination that must be removed), Epoxify may proceed to prevent system failure and charge accordingly, with documentation.
Concrete is not a manufactured sheet. It contains:
-cracks
-shrinkage lines
-cold joints
-saw cuts
-spalling
-patch areas
-moisture pathways
-contamination zones
-hardness variations
Even with elite prep, these realities can affect appearance and performance.
Metallic systems are not paint. The look is created by flowing pigments, solvents, additives, heat movement, and application technique. You agree:
1. Metallic floors will have variation.
2. Patterning cannot be exactly repeated from photos.
3. “Perfect symmetry” is not guaranteed.
4. Some areas may show stronger movement, marbling, or depth than others.
You agreed that there will always be some color variation but mostly accurate. You also agree:
1. On-screen colors differ from real life due to lighting and display settings.
2. Different rooms have different lighting temperatures (warm vs cool).
3. Pigments may appear different as they cure.
Epoxify aims for the intended direction and aesthetic, not a laboratory match.
If the slab has paint, glue, sealer, densifier, mastic, or unknown coatings, removal may require extra grinding, scraping, or specialty methods. If discovered after starting, it becomes a Change Order.
Cracks can telegraph through coatings or reappear due to slab movement, temperature change, settling, heavy loads, seismic activity, or hydrostatic pressure. Crack repair reduces risk but cannot guarantee permanent invisibility.
Moisture is one of the biggest causes of coating failure.
Epoxify may recommend or require moisture testing depending on:
1. property history
2. visible signs (efflorescence, dark spots, past peeling)
3. age of slab
4. below-grade or poorly drained areas
5. prior coating failures
Testing may include surface meters, calcium chloride, RH probes, or other industry methods. No test guarantees future moisture behavior.
If moisture levels are high or risk indicators are present, Epoxify may recommend a moisture vapor barrier or mitigation primer. If the customer refuses recommended moisture mitigation, warranty coverage for adhesion, bubbling, blistering, or delamination related to moisture may be excluded.
Leaks, plumbing failures, groundwater intrusion, sprinkler overspray, flooding, drainage failures, or improper slope are not controlled by Epoxify and are excluded from warranty.
You agree the Project Site may contain hazards during work:
-dust from grinding
-chemical odors
-wet coatings
-loud equipment
-power cords and trip hazards
Epoxify will use reasonable safety practices, but you must keep non-workers out of the area. If you request that work continue while your family, employees, or customers remain present, you accept the risk.
Epoxify may refuse or stop work if:
-site is unsafe
-hazardous materials are present (asbestos, unknown chemicals)
-aggressive behavior or harassment occurs
-animals or unauthorized persons interfere
-customer demands unsafe shortcuts
-customer refuses to pay as agreed
In such cases, customer remains responsible for completed work and materials ordered.
This section is the warranty policy and is part of the Terms.
Epoxify provides a 5-year limited workmanship warranty starting from the date of Substantial Completion, subject to all exclusions and conditions below.
Epoxify may offer an optional extended warranty up to 10 years for an additional fee depending on project size, system type, moisture risk, and topcoat selection. The extended warranty is only valid if purchased in writing and paid in full.
This limited warranty covers workmanship-related failures under normal, intended use, specifically:
-delamination or peeling caused by improper surface preparation or improper application by Epoxify
-coating failure directly attributable to Epoxify labor errors, as determined by Epoxify after inspection
If a covered defect occurs during the warranty period, Epoxify will, at its option:
1. Repair the affected area, or
2. Recoat the affected area, or
3. Replace the system in the affected area (rare, at Epoxify’s discretion)
Warranty remedy is limited to the affected area only, not the entire project, unless Epoxify determines it is necessary.
This warranty does not cover:
-moisture vapor emission, hydrostatic pressure, water intrusion, flooding, plumbing leaks, sprinkler saturation, or dampness from below---grade conditions
-cracks, slab movement, settling, heaving, seismic activity, or structural failure
-normal wear and tear, abrasion, scratching, scuffing, loss of gloss, tire marks, or dulling over time
-chemical damage from acids, solvents, brake fluid, battery acid, harsh cleaners, or inappropriate degreasers
-impact damage, gouges, dents, dropped tools, dragged equipment, metal casters
-hot tire pickup, aggressive tire compounds, burnouts, racing tires, or repeated extreme heat
-UV yellowing or color shift (especially in areas exposed to sunlight), unless a UV-stable topcoat was selected and Epoxify specifically ----warranted UV behavior in writing
-cosmetic preferences or subjective dissatisfaction that does not reflect a defect
-variation in metallic patterning, swirls, marbling, pigment intensity, or “artistic randomness”
-prior coatings or contaminants not disclosed or not reasonably discoverable before grinding
-repairs performed by others or customer modifications
-failure to follow cure-time and maintenance instructions
Warranty is valid only if:
1. full payment has been made
2. customer followed cure-time instructions
3. customer performs reasonable maintenance
4. customer does not subject the floor to abuse outside intended use
5. customer promptly reports issues within a reasonable time after discovery
To submit a claim:
1. Email support@epoxify with photos and a description, including address and install date.
2. Epoxify may schedule an inspection.
3. If the issue appears non-warranty, Epoxify may charge an inspection fee, credited back if the claim is confirmed as covered.
Epoxify will determine cause using reasonable judgment, and customer agrees Epoxify’s determination controls unless otherwise required by law.
Extended warranty availability and price depend on:
-system selected
-topcoat selected
-moisture risk
-concrete condition
-total square footage
-customer usage type (residential vs commercial vs industrial)
Extended warranty may require additional steps (added moisture barrier, thicker topcoat, extra prep, or additional maintenance rules).
Unless Epoxify agrees in writing, warranties are not transferable to future owners or tenants. Epoxify may offer a paid transfer process on a case-by-case basis.
You agree that coated floors are not maintenance free. Proper care is required to preserve appearance and performance. At a minimum, you agree to:
1. Sweep or dust mop regularly to remove grit and debris.
2. Clean spills promptly.
3. Use non-abrasive cleaners approved for epoxy, urethane, or polyaspartic coatings.
4. Avoid harsh acids, degreasers, citrus solvents, or ammonia unless approved.
5. Use soft pads under heavy equipment, tool chests, appliances, and furniture.
Failure to maintain the floor may void warranty coverage for wear, dulling, or damage.
For commercial or industrial spaces:
1. You agree that forklifts, pallet jacks, carts, metal casters, and dragging loads accelerate wear.
2. Epoxify may recommend thicker topcoats, additional coats, or maintenance recoat schedules.
3. Normal wear in high-traffic zones is not a defect.
All coating systems benefit from periodic refresh coats. Epoxify may recommend re-topcoating after years of use. This is maintenance, not warranty work.
You agree to follow cure-time instructions exactly. Typical guidance (varies by system):
-Light foot traffic: 12–24 hours
-Heavy foot traffic: 24–48 hours
-Vehicles: 48–96 hours
-Heavy loads or hot tires: up to 7 days
Using the floor early can cause permanent damage that is not covered by warranty.
You agree to:
1. Avoid water exposure during cure.
2, Keep doors closed unless instructed otherwise.
3. Avoid fans or heaters unless approved by Epoxify.
4. Prevent dust, leaves, pets, or debris from entering the area.
All coating systems benefit from periodic refresh coats. Epoxify may recommend re-topcoating after years of use. This is maintenance, not warranty work.
You acknowledge that:
1. Coatings interact with concrete, which is not uniform.
2. Even with correct prep, unpredictable results can occur due to slab behavior.
3. No coating system is indestructible.
4. Cosmetic perfection is subjective.
By proceeding, you accept these inherent risks.
To the maximum extent permitted by California law, Epoxify’s total liability for any claim, whether in contract, tort, negligence, strict liability, or otherwise, is limited to the amount you actually paid Epoxify for the specific portion of work giving rise to the claim.
Epoxify shall not be liable for:
-indirect damages
-incidental damages
-consequential damages
-loss of use
-loss of business
-loss of profits
-loss of rent or downtime
-emotional distress
Even if Epoxify was advised such damages were possible.
Any statements made verbally, in marketing, on social media, or in informal messages do not expand liability or create additional warranties beyond what is written here.
You agree to indemnify, defend, and hold harmless Epoxify LLC, its owners, managers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, or expenses (including attorney fees) arising from:
1. your misuse of the floor
2. your failure to follow instructions
3. your failure to disclose site conditions
4. injuries to third parties due to your failure to restrict access
5. damage caused by your equipment, tenants, employees, or guests
6. inaccurate information you provided
Epoxify represents that it operates as a licensed and insured company at the time of service. Licensing is provided through a Responsible Managing Officer (RMO) arrangement where applicable. Proof of insurance may be provided upon reasonable request.
You acknowledge that licensing classifications, regulatory requirements, and disclosure obligations vary by jurisdiction and scope of work, and you agree not to misrepresent Epoxify’s licensing status to third parties.
If you cancel:
1. Deposits covering materials already ordered are non-refundable.
2. Labor scheduling fees may apply.
3. Custom pigments, tinted resins, and special-order products are not refundable.
Epoxify may cancel or reschedule if:
-conditions are unsafe or unsuitable
-moisture or substrate conditions make a proper install impossible
-customer breaches payment or access obligations
-force majeure events occur
In such cases, Epoxify will refund unused materials or payments not earned, minus reasonable costs incurred.
Epoxify is not liable for failure or delay due to events beyond reasonable control, including but not limited to:
-acts of God
-weather events
-earthquakes
-fires
-floods
-power outages
-labor shortages
-supply chain disruptions
-government orders
You grant Epoxify the right to photograph and video the Project Site before, during, and after installation for documentation, quality control, marketing, advertising, website, social media, and portfolio use.
Epoxify will avoid showing identifying personal items when reasonable and will ask before showing identifiable people. If you object, you must notify Epoxify in writing before work begins.
You waive any right to compensation for use of photos or videos.
All designs, system builds, processes, photos, videos, text, and branding belong to Epoxify. You may not reuse Epoxify materials for commercial purposes without written permission.
The website is for informational purposes only and does not constitute a binding offer.
Email, SMS, and messaging are acceptable forms of communication. However:

These Terms, together with any Work Order or written addendum, constitute the entire agreement between you and Epoxify and supersede all prior discussions or representations.
Epoxify may update these Terms periodically. The version in effect at the time of your contract governs your project.
By approving an estimate, paying a deposit, allowing work to begin, or using the website, you acknowledge that you have read, understood, and agreed to these Terms of Service and Warranty Policy.
